TABLE OF CONTENTS

1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Sensitive Information. We do not process sensitive information.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information, such as your Internet Protocol (IP) address and/or browser and device characteristics, is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. On its own, this information does not reveal your name or contact details, but it may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. If you submit a form, or if you allow Marketing, some of our tools link this information to you personally, as described in section 4.

Information from identity-resolution and sales-intelligence providers

If you allow Marketing, Valley, our sales-intelligence provider, uses LiveIntent's identity-resolution service to look up a hashed email address associated with your browser, and links your visit to it. This can tell us who visited our site and which pages they viewed, and our sales team may use it to contact you about our products, for example by email or on LinkedIn. Separately, Snitcher (part of Analytics) tells us which company or organization an IP address belongs to, not who you are.

Like many businesses, we also collect information through cookies and similar technologies.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts.
  • To deliver and facilitate delivery of services to the user.
  • To respond to user inquiries and offer support.
  • To send administrative information and service-related updates.
  • To protect the security and integrity of our Services, prevent fraud, and enforce our terms.
  • To comply with our legal obligations.
  • To understand how our site is used and improve it (Analytics, see section 4).
  • To learn which organizations visit us and, if you allow Marketing, which people, so our sales team can follow up (see section 4).
  • To measure and target our advertising, including counting demo bookings and contact-form submissions that come from our ads (Marketing, see section 4).

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following third parties.

We may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Notice. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.
  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.
  • Service providers. Vercel (Vercel Inc., United States) hosts our website and processes your IP address and request logs to serve and secure it. Submissions from our forms are delivered to our team through Slack (Slack Technologies, LLC, United States). They process this information on our behalf.
  • Analytics, identification and advertising vendors. The vendors listed in section 4 (Google, PostHog, Snitcher, Valley and LiveIntent, Meta, X, OpenAI and Cal.com) receive information from your browser when their purpose is active.

4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We use cookies, pixels and similar technologies for analytics, company identification and advertising. Each vendor and what it receives is listed below.

We use cookies and similar technologies (such as pixels, web beacons, local storage and scripts) to measure how the site is used, to learn which organizations (and, with Marketing, which people) visit us, and to measure and target our advertising. These tools collect your IP address, device and browser details, approximate location derived from your IP address, the pages you view and the links and buttons you click, the page that referred you, and identifiers stored in cookies or local storage. The vendors below receive this information directly from your browser.

Analytics and company identification

  • Google Analytics 4 (Google LLC, United States): page views, events and traffic sources, with Google Consent Mode set to denied until this purpose is granted.
  • PostHog (PostHog Inc., United States, US data region): page views, clicks captured automatically (autocapture), time on page and, only after you grant Analytics yourself, session recordings that replay your mouse movements, scrolling and clicks on our pages. Everything typed into form fields is masked before a recording leaves your browser, and our contact forms are masked entirely. When you successfully submit a form on our site with your email address, PostHog links that email address to the visits it has recorded in your browser, so we can see which pages you viewed.
  • Snitcher (also shown as Monaco/Radar; Snitcher B.V., Netherlands): matches your IP address against business databases to identify the company or organization associated with your visit.

Marketing and advertising

  • Meta Pixel (Meta Platforms, Inc., United States, and Meta Platforms Ireland Ltd.): page views, used to measure and retarget our ads on Facebook and Instagram. We have turned off the pixel's automatic event setup, so it does not separately collect the buttons you click or details from our pages.
  • X Pixel (X Corp., United States): page views, used to measure and retarget our ads on X.
  • OpenAI Ads pixel (OpenAI, L.L.C., United States): page visits, the attribution identifier OpenAI adds when you arrive from an ad in ChatGPT, and two conversions (a confirmed demo booking and an accepted contact-form submission, each with a random event ID), used to measure our ads in ChatGPT. The pixel's automatic advanced matching is turned on: when you type your email address, name or phone number into a form on our site, the pixel hashes them in your browser and sends the hashed values to OpenAI with its events, so OpenAI can match your visit to a ChatGPT account.
  • Valley (Valley, sales intelligence, joinvalley.co), using LiveIntent (LiveIntent, Inc., United States): Valley's script loads LiveIntent's identity-resolution script, which looks up a hashed email address associated with your browser. Valley receives that hashed email address and the address of the page you are on, so we can learn which people, not only which companies, visited our site; our sales team may contact you as a result. LiveIntent may set its own cookies on our site.
  • Cal.com (Cal.com, Inc., United States): our demo scheduler pop-up, prefilled with the name and email you already gave us on this site.

Meta, X and OpenAI can link your visit to an account you hold with them, and use the information under their own privacy policies. OpenAI receives hashed (one-way encoded) contact details as described above; Meta and X may receive them too where their matching features are turned on. Hashing hides the original value, but the recipient can still match it to an account that uses the same email address or phone number. None of these tools load until Marketing is allowed in your region or by your choice.

Cookies and stored items

  • Always active (set by us): hc_region and hc_subregion (cookies, 1 hour: your country and, in the United States and Canada, your state or province, worked out from your IP address and used only to decide which consent rules apply); harmony_consent_v1 (local storage: your consent choice; an acceptance is honored for up to 12 months and a rejection until you change it); harmony_email_popup_v1 and harmony_slidein_v1 (local storage: whether you closed or completed our email sign-up prompts, so they are not shown again for 1 day after you close them or 60 days after you sign up); harmony_lead_email (local storage, only after you submit your email address in one of our forms: used to prefill the demo scheduler, and deleted if you refuse or withdraw Marketing); harmony:yeehaw (local storage: whether you turned on the site's decorative animation mode).
  • Analytics and company identification: _ga and _ga_* (Google Analytics cookies, up to 2 years); ph_*_posthog (PostHog, cookie and local storage, up to 1 year); identifiers set by Snitcher's script.
  • Marketing and advertising: _fbp and _fbc (Meta cookies, 90 days); _twclid and other cookies set by X; __oppref, __obref, oaiq_consent and oaiq_cs:* (OpenAI); _lc2_fpi, _li_dcdm_c and _li_ss (LiveIntent, loaded by Valley); harmony_oai_sent (session storage, set by us: stops the same conversion being counted twice, deleted when you close the tab).

Where no lifetime is given, the vendor sets the lifetime of its own cookies and may change it. Vendors may also set cookies on their own domains, which are governed by their own policies.

How long tools keep data. Your consent choice is stored on your device for up to 12 months, after which we ask again, or until you change it; a choice to reject all is kept until you change it. Analytics, identification and advertising data are kept under each vendor's retention settings for our account and then deleted or anonymized by the vendor.

Turning tools off. Use the Change cookie preferences button above, the "Cookie preferences" or "Do Not Sell or Share My Personal Information" link in the footer of every page, or turn on Global Privacy Control in your browser. When you withdraw a purpose, we delete the cookies and stored identifiers we can reach for it and reload the page so the vendor scripts stop.

5. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.

We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

6. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" above), including facilities in the United States and other countries. The analytics, identification and advertising vendors listed in section 4 receive data directly from your browser, mostly in the United States (Snitcher is based in the Netherlands).

If you are a resident in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, then these countries may not necessarily have data protection laws or other similar laws as comprehensive as those in your country. The safeguards we rely on for these transfers are described in "If you are in the EEA, the UK or Switzerland" in section 9.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent's use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at info@tryharmony.ai.

9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.

Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time, as easily as you gave it, using the "Cookie preferences" (or "Do Not Sell or Share My Personal Information") link in the footer of every page, or by contacting us using the details in section 12.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can contact us at info@tryharmony.ai.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

If you are in the EEA, the UK or Switzerland

Harmony Intelligence Inc, 917 E 16th St, Chattanooga, TN 37408, USA (info@tryharmony.ai) is the controller of your personal information. Our legal bases are: your consent for analytics, company identification, session recording, advertising pixels, Valley and LiveIntent identification, and the Cal.com scheduler (GDPR art. 6(1)(a)); taking steps at your request before entering into a contract when you contact us or book a demo (art. 6(1)(b)); our legitimate interests in running and securing the site and replying to enquiries you send us (art. 6(1)(f)); and legal obligations (art. 6(1)(c)).

You have the right to access, correct and erase your personal information, to restrict or object to its processing, to data portability, and to withdraw your consent at any time without affecting processing before the withdrawal. To exercise these rights, email info@tryharmony.ai. You may also complain to your local data protection authority (in the UK, the Information Commissioner's Office; in Switzerland, the Federal Data Protection and Information Commissioner).

Transfers of your personal information to the United States rely on the recipient's certification under the EU-U.S. Data Privacy Framework, its UK Extension and the Swiss-U.S. Data Privacy Framework where the recipient is certified, and otherwise on the European Commission's Standard Contractual Clauses (with the UK Addendum and Swiss amendments where they apply) included in the recipient's data processing terms. You can ask us for more information about these safeguards at info@tryharmony.ai.

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not respond to DNT browser signals. We do honor the Global Privacy Control (GPC) signal: when your browser sends it, none of our analytics, identification or advertising tools load, the signal overrides any earlier acceptance, and the site shows that your opt-out request was honored.

11. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated "Revised" date at the top of this Privacy Notice. If we make material changes to this Privacy Notice, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this Privacy Notice frequently to be informed of how we are protecting your information.

12. HOW CAN YOU CONTACT US ABOUT THIS NOTICE?

If you have questions or comments about this notice, you may contact us by post at:

13. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, details about how we have processed it, correct inaccuracies, or delete your personal information. You may also have the right to withdraw your consent to our processing of your personal information. These rights may be limited in some circumstances by applicable law. To request to review, update, or delete your personal information, please contact us at info@tryharmony.ai.

14. NOTICE FOR CALIFORNIA AND OTHER US STATE RESIDENTS

In Short: This is our notice at collection. Advertising pixels may count as "selling" or "sharing" personal information, and you can opt out at any time.

Categories we collect through the site: identifiers (IP address, cookie and device identifiers, the name, email and phone number you choose to give us, and hashed versions of your email address and phone number); internet or other electronic network activity (pages viewed, clicks, referring page, and, with your consent, session recordings); approximate geolocation derived from your IP address; professional or employment-related information (the organization associated with your visit, and details you give in forms); and inferences about your or your organization's interest in our products. We collect these from you, from your browser and device, and, if Marketing is allowed, from LiveIntent through Valley. We do not collect sensitive personal information through the site, and we do not knowingly sell or share the personal information of anyone under 16.

Purposes: running and securing the site, analytics, identifying which organizations and people visit us so our sales team can follow up, responding to inquiries, and measuring and targeting our advertising (see sections 2 and 4).

Selling and sharing: making identifiers (including hashed contact details) and internet activity available to Meta, X and OpenAI through their pixels, for cross-context behavioral advertising, may be a "sale" or "sharing" under the California Consumer Privacy Act and similar state laws, and use for "targeted advertising" under other state laws. Identification tools (Valley and LiveIntent, and Snitcher) may also be treated as a sale. In the past 12 months we may have sold or shared identifiers, internet or other electronic network activity, approximate geolocation and inferences with these vendors. To opt out, use the Do Not Sell or Share My Personal Information link (also in the footer of every page when you visit from the United States; elsewhere the footer link is labeled "Cookie preferences") and choose Reject all, or turn on Global Privacy Control. California visitors are asked before any of these tools load, and visitors in Florida, Pennsylvania, Washington, Maryland and Illinois are asked before any marketing tool loads.

Retention: form submissions and contact details are kept while we have an active sales or business relationship with you or your organization, and then deleted or anonymized; analytics, session recordings and identification data are kept under each vendor's retention settings for our account (see section 4); the region cookies last 1 hour; and your consent choice stays on your device for up to 12 months, or until you change it.

Your rights: depending on your state, you may have the right to know, access, correct and delete your personal information, to opt out of its sale, sharing or use for targeted advertising, and to not be discriminated against for using these rights. Email info@tryharmony.ai to make a request; an authorized agent may make one on your behalf. We will verify your request before acting on it. If we decline your request, you may appeal by replying to our decision or by emailing info@tryharmony.ai with the subject "Privacy appeal". We will respond in writing within the time your state's law requires and explain the outcome; if your appeal is denied, you may contact your state Attorney General.
